TIME WARNER CABLE OF MAINE ROAD RUNNER
SUBSCRIBER PRIVACY NOTICE

As a subscriber to a cable television service furnished by Time Warner Cable of Maine , you are entitled under Section 631 of the federal Cable Communications Policy Act of 1984 (the "Cable Act") to know the limitations imposed upon cable operators by federal law in the collection and disclosure of personally identifiable subscriber information, the type of personally identifiable information collected, how subscriber information is used, under what conditions it is disclosed, the period during which it is maintained, and the rights of subscribers concerning such information and its disclosure.

This law relates only to personally identifiable information. It also applies only to information that you have furnished to us or certain information that is transmitted over cable facilities. Some of our services permit you to direct communications outside of our system. This law does not apply to information in communications via our Road Runner service once you have directed such information out of our system or control, for example, to the electronic sites on on-line services or to sites on the Internet.

In order that we may render service to you, we keep regular business records that contain the following types of personally identifiable information: your name, address, telephone numbers, social security number, credit information, subscriber correspondence and demographic data such as the number and ages of individuals in the household. Our records also include information on billing, payment, damage and security deposits, maintenance and repairs, how many television sets you have connected to cable or that are cable ready, the location of these television sets in your home, the number and location of PCS and your PC configuration, the service options you have chosen, and the number of converters or other cable equipment installed in your home. We keep records of research concerning subscriber satisfaction and viewing habits, which are obtained from subscriber interviews and questionnaires. In addition, to render Road Runner service to our customers, our cable system automatically collects some information on customer use of this service, including information on the choices that a customer makes among the range of services offered, when a customer visits a site, and how long he or she visits the site. Our uses of the information are limited to the purposes described below.

When you use the cable system to transmit information addressed to other individuals, for example, through "electronic mail" (e-mail), federal law permits us to collect information about the content of those transmissions when it is necessary to provide a cable or other service you have requested, in order to prevent unauthorized access to services or to subscriber data, or with your written or electronic consent. Information contained in your transmissions directed at or addressed to Time Warner Cable of Maine , or services offered or areas maintained by it, is information necessary to provide a service you have requested.

Our detailed business records are used generally to help make sure you are being properly billed for the services you receive; to send you pertinent information regarding your cable or other services; to improve the quality of the services we provide; and for tax and accounting purposes. The information on subscriber use of the Road Runner service also is used to understand subscriber reactions to the content offerings, gateways and other services we offer and to evaluate and develop the network. It helps us to customize the Road Runner service based on the interests of our subscribers, helps us to be more selective in the types of commercial communications we address to you and is necessary for analyzing network performance levels.

Time Warner Cable of Maine considers the personally identifiable information we keep to be confidential. Unless prior written or electronic consent is obtained, we will disclose to third parties personally identifiable information that we maintain related to our customers only when it is necessary to render cable or other service to you or to carry out related business activities in the ordinary course of business for our ordinary business purposes, at a frequency that serves the particular business need. The types of persons to whom information about you may be disclosed in the course of our business include our employees and the employees of Time Warner Entertainment Company, L.P., and other related legal entities; agents; billing and collection services; installation, repair, and subscriber assistance subcontractors; program guide distributors; software vendors; and firms conducting market research for us. Time Warner Cable of Maine may also disclose personally identifiable information about you to representatives of governmental entities as necessary to render this cable service and to conduct our legitimate business activities related thereto.

Federal law authorizes all of these disclosures. In addition, federal law authorizes us to disclose personally identifiable information to a governmental entity or other third party when disclosure is required pursuant to a court order. If the court order is being sought by a governmental entity, the law requires that you be afforded the opportunity to contest in court any claims made in support of the court order sought. In addition, pursuant to an administrative subpoena, state welfare agencies may obtain the names and addresses of individuals as they appear in the customer records of cable television companies with respect to those who owe, or are owed, welfare support. Such information may be obtained without a court order and does not require that a subscriber be given notice of and the opportunity to contest the disclosure.

Unless you object, federal law also allows us to disclose certain information to others, including advertisers and direct mail or telemarketers, for non-cable related purposes, including product advertising, direct marketing, and research. Disclosure for such purposes is limited to your name, address, and the particular services to which you subscribe, but cannot include the extent of your viewing or use of a particular service or the nature of any transaction you may make over the cable system. We typically provide names and addresses of subscribers to third parties that we find appropriate as often as requested. Alternatively you may notify us in writing at the system office at: 118 Johnson Rd, Portland, ME 04102-1911. We will then not make your name and address available for such non-cable purposes.

We will maintain personally identifiable information about you only so long as it is necessary for our business purposes. This period of time lasts as long as you are a subscriber and potentially up to fifteen additional years so that we can comply with tax and accounting requirements.

You have the right to inspect our records that contain information about you and to correct any errors in such information. If you wish to inspect our records at our local business office, located at 118 Johnson Rd., Portland, ME, 04102-1911, please notify us in writing thirty (30) days in advance and an appointment will be arranged promptly during our regular business hours. Additionally, as a cable subscriber, you have a cause of action for damages, attorney's fees and costs should you believe that any of the applicable limitations on the collection, disclosure and retention of personally identifiable information have been violated by us.
